Welcome to KrowdSpot.
These Terms of Service (“Terms”) govern your access to and use of KrowdSpot, including our website, applications, features, and services (collectively, the “Service”).
KrowdSpot is an independent, individually operated project based in Ghana. By accessing or using KrowdSpot, you agree to these Terms. If you do not agree with them, please do not use the Service.
1. What KrowdSpot Does
KrowdSpot is a free, crowd-sourced platform for discovering places, activities, and things to do.
The Service may contain information about restaurants, cafés, hotels, activities, entertainment venues, shops, outdoor locations, and other places.
Some information is submitted by users and members of the public. This means that information on KrowdSpot may be incomplete, outdated, inaccurate, or incorrect.
KrowdSpot does not guarantee that any place, listing, review, rating, opening hour, price, address, photograph, or other information is accurate or current.
You should independently verify important information before relying on it.
2. Eligibility
You may use KrowdSpot only if you are legally permitted to do so under the laws applicable to you.
If you are under the age required to enter into these Terms under applicable law, you should use KrowdSpot only with the involvement and permission of a parent or legal guardian where required.
3. Accounts
Some features require an account.
You are responsible for:
- providing accurate information;
- maintaining the security of your account;
- keeping your login credentials confidential; and
- activity that occurs through your account.
Do not create an account using another person's identity or information without permission.
We may suspend or restrict accounts that violate these Terms or are used to abuse the Service.
4. User Contributions
KrowdSpot allows users to submit content, including reviews, ratings, photographs, place information, corrections, descriptions, suggestions, and reports.
You retain ownership of content that you submit.
By submitting content to KrowdSpot, you grant KrowdSpot a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, modify, adapt, display, distribute, and otherwise use that content as reasonably necessary to operate, maintain, improve, and promote the Service.
This license does not transfer ownership of your content to KrowdSpot.
You represent that you have the right to submit the content, it does not knowingly infringe another person's intellectual property rights, it is not intentionally misleading, it does not contain unlawful material, and it does not violate these Terms.
Do not upload photographs or other material that you do not have permission to use.
5. Reviews and Ratings
Reviews and ratings represent the opinions of the users who submit them. KrowdSpot does not endorse every review, rating, or statement posted by users.
You must not submit fake reviews, review a place solely to manipulate its rating, create multiple accounts to manipulate ratings, submit reviews in exchange for undisclosed compensation, impersonate another person, intentionally submit misleading information, or coordinate artificial engagement.
We may remove or restrict content that violates these rules or otherwise harms the integrity of KrowdSpot.
6. Prohibited Use
You may not use KrowdSpot to break the law, harass or abuse others, impersonate another person, distribute malware, interfere with the Service, attempt unauthorized access, scrape data in a harmful manner, manipulate ratings or reviews, upload infringing or unlawful content, or use automated systems to abuse the Service.
We may take reasonable action against accounts, content, or activity that violates these Terms.
7. Place Information
KrowdSpot is a discovery platform, not a guarantee of the quality, safety, legality, availability, or suitability of any listed place. A listing on KrowdSpot does not mean that KrowdSpot recommends, certifies, inspects, or endorses that place.
Information such as opening hours, prices, amenities, availability, menus, addresses, and contact information can change. Always confirm important details directly with the relevant business or location.
8. Directions and Location Information
KrowdSpot may use location information to provide nearby discovery and map features. Map data, directions, distances, and location information may contain errors. Do not rely exclusively on KrowdSpot for navigation, emergency situations, or safety-critical decisions.
9. Intellectual Property
The KrowdSpot name, branding, interface, software, original designs, and other materials created by KrowdSpot are owned by or licensed to the operator unless otherwise stated. You may not reproduce, modify, distribute, sell, or commercially exploit KrowdSpot's proprietary materials without permission.
Third-party trademarks, logos, photographs, and other materials remain the property of their respective owners.
10. Third-Party Services
KrowdSpot may rely on third-party services for maps, authentication, hosting, databases, image storage, analytics, and other infrastructure. Those services may have their own terms and privacy policies. KrowdSpot is not responsible for the availability or operation of third-party services.
11. Availability
We aim to keep KrowdSpot available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Service when reasonably necessary.
12. Disclaimer
KrowdSpot is provided on an “as is” and “as available” basis to the extent permitted by applicable law. We do not guarantee that the Service will always be available, information will always be accurate or complete, listings will remain available, reviews will be reliable, the Service will be error-free, or the Service will meet every user's requirements.
Nothing in these Terms excludes or limits a right or remedy that cannot legally be excluded or limited under applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, KrowdSpot and its operator will not be liable for indirect, incidental, special, consequential, or similar losses arising from your use of or inability to use the Service. This includes losses arising from reliance on user-generated content, place information, reviews, ratings, directions, availability information, or third-party services.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
14. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and expenses arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person's rights.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice where appropriate. Your continued use of KrowdSpot after updated Terms become effective means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Subject to any mandatory rights you may have under applicable law, disputes relating to these Terms or the Service will be subject to the jurisdiction of the courts of Ghana.
